1. Scope of This Policy

This Privacy Policy describes how Leona Sports Agency LLC d/b/a The Baseball Agent™ (the "Company," "we," "us," or "our") collects, uses, discloses, and protects personal information when you visit thebaseballagent.com or leonasportsagency.com, create an account, join The Dugout community, book a session, purchase a Program, or otherwise interact with our Services. It applies to customers, prospective customers, community members, newsletter subscribers, and site visitors.

Personal information relating to individuals under eighteen (18) years of age is additionally governed by our Children's Privacy and Minor Participation Policy, which supplements this Policy and controls in the event of any conflict with respect to minors.

This Policy does not apply to third-party websites, platforms, or services that we do not control, including social media platforms, payment processors, and external storefronts, even where we link to them or operate a presence on them.

2. Information We Collect

Information you provide directly. We collect information you choose to provide, which may include: name; email address; mailing address; phone number; account username and password; billing information (processed by our payment processors; we do not store full payment card numbers); information you submit in web forms, applications, surveys, or booking requests; questions, posts, and other content you share in our communities; communications you send to us; and, where you enroll a minor participant, the parent or guardian information and limited participant information described in our Children's Privacy and Minor Participation Policy.

Information collected automatically. When you use the Site, we and our service providers automatically collect certain information from your device using cookies, pixels, web beacons, log files, and similar technologies. This may include IP address, approximate location derived from IP address, browser and operating system, device identifiers, referring pages, pages viewed, dates and times of access, video playback activity, and other usage data. Our email campaigns may use similar technologies to measure delivery and engagement.

Information from third parties. We may receive information about you from service providers and platforms that support our business, such as our website host, scheduling tools, payment processors, e-commerce storefronts, analytics providers, and advertising partners, and from social media platforms when you interact with our pages or advertisements on those platforms.

3. How We Use Personal Information

We use personal information for the following purposes:

  • to provide the Services, including creating and administering accounts, delivering Program content, operating communities, scheduling and conducting sessions, and processing payments;

  • to communicate with you about your purchases, account, and the Services, including transactional and relationship messages;

  • to send marketing communications, subject to your right to opt out at any time;

  • to personalize and improve the Services, develop new offerings, and understand how the Services are used;

  • to maintain the safety, security, and integrity of the Services, including detecting, investigating, and preventing fraud, credential sharing, unauthorized access, content piracy, and other misuse;

  • to enforce our Terms of Service and protect our legal rights, including our intellectual property;

  • to comply with legal obligations, respond to lawful requests, and establish, exercise, or defend legal claims; and

  • for any other purpose disclosed to you at the time of collection or with your consent.

4. How We Disclose Personal Information

We do not sell your personal information for money. We may disclose personal information in the following circumstances:

  • Service providers. With vendors that perform services on our behalf, such as website hosting and site infrastructure, payment processing, scheduling, email and text communications, video hosting, analytics, customer support, and security, under obligations to use the information only to provide those services;

  • Advertising and analytics partners. With analytics and advertising partners that help us measure site performance and reach relevant audiences; depending on your state of residence, certain sharing for cross-context behavioral advertising may be considered a "sale" or "sharing" under state privacy law, and you may opt out as described in Section 8;

  • Legal compliance and protection. When we believe disclosure is required by law, subpoena, or legal process, or is appropriate to protect the rights, property, or safety of the Company, our members (including minor participants), or the public, or to enforce our agreements;

  • Business transfers. In connection with a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or part of our assets, in which case personal information may be transferred as a business asset subject to this Policy; and

  • With your consent, or at your direction.

We may disclose de-identified or aggregated information that cannot reasonably be used to identify you without restriction.

Community features are visible to other members. Anything you post in The Dugout or other interactive areas can be seen by other participants. Do not post information you wish to keep private.

5. Cookies and Tracking Choices

We use strictly necessary cookies to operate the Site, functional cookies to remember preferences, analytics cookies to understand usage, and, where deployed, advertising cookies to measure and improve campaigns. You can control cookies through your browser settings and, where available, through the cookie preferences tool on the Site; disabling certain cookies may impair Site functionality. To learn about and opt out of interest-based advertising generally, visit www.aboutads.info. To opt out of Google Analytics, visit tools.google.com/dlpage/gaoptout. Our Site does not currently respond to "Do Not Track" browser signals, but where required by law we honor opt-out preference signals such as the Global Privacy Control.

6. Data Retention

We retain personal information only as long as reasonably necessary for the purposes described in this Policy, including providing the Services, complying with legal, tax, and accounting obligations, resolving disputes, enforcing agreements, and maintaining business records. Retention periods vary by record type; for example, purchase records are retained as required for tax purposes, while marketing data is retained until you opt out or the data is no longer needed. When personal information is no longer required, we delete or de-identify it.

7. How We Protect Personal Information; Security Incidents

We maintain administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, alteration, and destruction. These measures include transport-layer encryption (HTTPS/SSL) on the Site, reliance on established hosting and payment infrastructure, access controls limiting who may reach account and back-end systems, and payment card processing handled by PCI DSS compliant processors so that full card numbers are not stored on our systems.

No method of transmission over the internet or method of electronic storage is completely secure, and we cannot guarantee absolute security. You are responsible for maintaining the secrecy of your credentials and for using a strong, unique password.

If we determine that a security incident has resulted in unauthorized access to personal information in our custody in a manner that triggers notification obligations under applicable law, we will notify affected individuals and regulators in the manner and within the timeframes required by the data breach notification laws of the relevant jurisdictions, and we will take reasonable steps to contain and remediate the incident. To the fullest extent permitted by law, the Company is not liable for damages arising from the criminal or otherwise unauthorized acts of third parties, including hacking, credential theft, and intrusion into systems operated by us or our service providers, except to the extent such liability cannot be disclaimed under applicable law.

8. Your Privacy Rights

State privacy rights. Depending on where you live, you may have some or all of the following rights under state privacy laws such as the California Consumer Privacy Act as amended by the California Privacy Rights Act, and comparable laws in other states: the right to know or access the personal information we hold about you; the right to correct inaccurate personal information; the right to delete personal information, subject to legal exceptions; the right to opt out of the sale or sharing of personal information and of targeted advertising; the right to limit the use of sensitive personal information, which we do not use for purposes requiring such a limitation; the right to data portability; and the right not to receive discriminatory treatment for exercising your rights.

How to exercise your rights. We will verify your identity using information associated with your account before acting on a request, respond within the time required by applicable law, and explain the basis for any denial. Parents and guardians may exercise these rights on behalf of their minor children as described in our Children's Privacy and Minor Participation Policy.

Marketing choices. You may unsubscribe from marketing emails using the link in any marketing message, and you may stop marketing text messages, if any, by replying STOP. We will continue to send non-marketing messages about your account and purchases.

Visitors outside the United States. The Services are operated from the United States and are directed to a United States audience. If you access the Services from outside the United States, you understand that your information will be transferred to, stored, and processed in the United States, where privacy laws may differ from those in your jurisdiction. Where the law of your jurisdiction grants you additional rights, such as rights of access, rectification, erasure, restriction, portability, and objection under the EU or UK General Data Protection Regulation, we will honor valid requests to the extent those laws apply to our processing. Our legal bases for processing in such cases are performance of a contract, our legitimate interests in operating and protecting the Services, compliance with legal obligations, and consent where required.

9. Children's Privacy

The Site is intended for a general adult audience. We do not knowingly collect personal information from children under thirteen (13), and children under thirteen may not use the Services. Participation by minors aged thirteen (13) to seventeen (17) is permitted only in designated Programs with verifiable parental consent, and is governed by our Children's Privacy and Minor Participation Policy. If you believe a child has provided us personal information without required consent, contact us at Contact@leonasportsagency.com and we will delete it.

10. Changes to This Policy

We may update this Privacy Policy from time to time. The updated version will be posted on this page with a revised effective date, and we will provide additional notice of material changes as required by law, such as by email or a prominent notice on the Site. Your continued use of the Services after the effective date constitutes acceptance of the updated Policy.

Children's Privacy and Minor Participation Policy

1. Purpose

Leona Sports Agency LLC d/b/a The Baseball Agent™ (the "Company") takes the privacy and safety of minors seriously. This Policy explains the rules that govern participation in our Programs and communities by individuals under eighteen (18) years of age ("Minor Participants"), and how we handle their personal information in compliance with the Children's Online Privacy Protection Act ("COPPA"), its implementing rule as amended, and applicable state law. This Policy supplements our Privacy Policy and Terms of Service and controls over them with respect to Minor Participants.

2. Children Under Thirteen

The Services are not directed to children under thirteen (13). Children under thirteen may not create accounts, join The Dugout or any other community, book sessions, or submit personal information through the Site, and we do not knowingly collect personal information from them. If we learn that we have collected personal information from a child under thirteen without verifiable parental consent, we will delete that information promptly and terminate any associated account. Parents who believe their child under thirteen has provided information to us should contact us at contact@leonasportsagency.com.

3. Participants Aged Thirteen to Seventeen

Minors aged thirteen (13) to seventeen (17) may participate in Programs designated by the Company as open to minors, subject to all of the following conditions:

  • the purchase is completed by the minor's parent or legal guardian using the parent's or guardian's own payment method;

  • the parent or guardian accepts the Terms of Service, including the No Refund Policy, on the minor's behalf and agrees to this Policy;

  • the parent or guardian provides consent through the consent mechanism we specify at enrollment, and re-confirms consent upon our request;

  • the account is registered under the supervision of the parent or guardian, who is responsible for monitoring the minor's use of the Services; and

  • the minor complies with the Terms of Service and all community guidelines.

We may decline, suspend, or condition any minor's participation at our discretion, including where we cannot reasonably verify parental consent.

4. Information We Collect About Minor Participants

We collect only the information reasonably necessary to enroll and support a Minor Participant. This is limited to: the minor's first and last name; age or date of birth (to confirm eligibility); the parent or guardian's name, email address, phone number, and billing information; the minor's account username; and content the minor submits within the Services, such as community posts and questions. We do not require a Minor Participant to disclose more information than is reasonably necessary to participate, and we do not use minors' personal information for targeted or behavioral advertising, do not sell it, and do not disclose it to third parties except to service providers necessary to operate the Services, to comply with law, or to protect safety.

5. Parental Rights

A parent or legal guardian of a Minor Participant may, at any time: review the personal information we have collected about their child; direct us to correct or delete that information; refuse to permit further collection or use of the information; and withdraw consent and terminate the minor's participation. To exercise these rights, contact us at contact@leonasportsagency.com with the subject line "Parent Request." We will verify that the requester is the child's parent or guardian before acting. Withdrawal of consent or deletion of information may end the minor's ability to participate in a Program; consistent with our Terms of Service, withdrawal does not entitle the purchaser to a refund except where required by law.

6. Community Safeguards

Our communities are professional educational spaces attended primarily by adults. To protect Minor Participants we apply the following safeguards: community conduct rules prohibiting harassment, solicitation, and the exchange of personal contact information with minors; moderation of community spaces and removal of content or members that present a risk to minors; a prohibition on private commercial solicitation of Minor Participants by other members; and instructions to Minor Participants not to post personal contact information, location details, or other sensitive information in community areas. Parents and guardians should nonetheless supervise their child's participation, and any concern regarding member conduct toward a minor should be reported immediately to Contact@leonasportsagency.com. We reserve the right to remove any member, without refund, whose conduct we reasonably determine endangers or is inappropriate toward a Minor Participant, and to report conduct to law enforcement where appropriate.

7. Retention and Deletion

We retain Minor Participants' personal information only as long as reasonably necessary to fulfill the purpose for which it was collected, and we delete it when it is no longer needed or upon a verified parental request, subject to information we must retain to comply with law, complete transactions, or protect legal rights.
